Pet Quality Contract Meaning of Pet
Quality Contract, there are no guarantees this said animal for breeding. There
are no guarantees on Hip Dysplasia, or any form of Dysplasia. Due to the fact
Dysplasia can be brought on by many different factors.

I, Renay Arduser,
agree to sell one Rottweiler puppy to the undersigned Buyer(s) ______________________________,

under the terms of this contract. There is to be a $ 200.00 deposit made to reserve a puppy from any litter, or upcoming litter. This deposit is non-refundable if the buyer(s) should change their mind about buying the dog at anytime. This is a commitment to Ardusers Rottweiler puppy as they are available. Deposits can be moved to other litters but will be under NO circumstances refunded.
Deposits and/or payments in full, will be transferred to the next available
litter.Even if the dam didn't settle or incases that the litter was lost, no
money will be returned at anytime. ALL MONIES
RECEIVED ARE NON-REFUNDABLE.
This deposit will go towards the selling price of the puppy, which will be
$___________ This is to be paid in full by time the puppy leaves my premises
and is of 8 wks of age, unless
other agreements are made by the seller of the puppy.
ALL shipping costs are buyer’s responsibility. This
puppy is guaranteed to be in good health to the best of our knowledge, at the
time of this sale. The buyer(s) has a health guarantee extending to the close
of three (3) business days in which to have the puppy examined by a licensed
veterinarian and is urged to do so. Upon examination by a licensed
veterinarian, should (He or She) find a life threatening situation with the
said puppy. (Except low grade
heart mummers). The licensed
veterinarian must contact Renay or Ken Arduser that same day the examination
occurred. 515-689-9091.
The said puppy will be exchanged for another puppy of equal value
(when available) of the buyer(s)’s choice provided a letter from the
examining veterinarian is offered as evidence of the puppy’s condition, and
the puppy is returned within 72 hrs. from diagnosis. IT IS AGREED AND
UNDERSTOOD THAT NO MONEY IS REFUNDED!!!

This
puppy comes from outstanding German Bloodlines. All parents have hip,
temperament and confirmation approval to breed. This puppy has been bred
with the intent to better the Rottweiler breed. It is your responsibility
as the buyer of this puppy to take exceptional care of your puppy: Socializing
the puppy upon arrival at your home and continuing socialization until the
said dog is at least 2 years old. Socializing means taking the dog/puppy to
various environments at least 4 times a week and having the puppy interact
with different types of people as often as possible. Appropriate medical,
nutritional, and physical (exercise) care is essential for the puppy to thrive
and develop properly. The puppy should be treated as a part of your family;
never chained up, left in the backyard/kennel for long
periods of time. Remember
the puppy is what you make Him /Her. Environment
and how he/she is raised plays a critical part in how your puppy will turn
out. The dog’s owner is almost always responsible for aggression and
temperament problems. Replacements:
If all requirements as stated above have been fulfilled and the buyer is to
replace the said dog/pup. Buyer is offered A replacement pup at Pet Quality
price _______ Replacements are given after the said dog has been spayed/
neutered and documentation has been provided to the Seller, AKC papers for the
original dog are also to be signed and returned to the Seller. This is to
ensure that the Dog is being utilized as a family pet and not for breeding or
for resale. Seller will assist in finding a suitable home for the said Dog
being replaced if necessary. Once the replacement pup has been received the
warrantee has been fulfilled, extended warrantee is NOT transferable to the
replacement pup. Ardusers
Rottweilers reserve the right to refuse replacement of any Dog/Puppy returned
for temperament or hip problems caused by owner negligence or abuse
and improper care/breeding of the animal. Failure seek veterinarians’ medical treatment when the said dog/puppy
has an injury.
This
includes but is not limited to over feeding the dog, especially during the
first two years, excessive exercise, and improper socialization. Excessive
crate use. Any dog that is altered
prior to 2 years old, via surgical procedure (i.e. Neutered/Spayed, hip
surgery, etc.) will be exempt; hence, buyer will not be entitled to a
replacement puppy. Under
NO circumstances will cash be refunded, at ANY time. Seller
shall not be held responsible
for any damages to Buyer’s/owner’s household or for any injuries resulting
from the dog biting anyone at any time. Any
changes of notification of the terms in this contract will be made in writing,
signed by both parties, and attached to this contract. NO verbal agreements of
any kind shall change or alter this Contract. Any breech of the requirements
stated in this contract shall render any warrantees or guarantees Null and
Void; Seller is released of any obligations of this
contract. Seller has no
obligation to reimburse Buyer for any costs incurred, i.e., medical, shipping,
crate, etc. Seller does not guarantee against conditions brought on by
stress or environmental changes that we can’t control once the puppy leaves
our care; therefore our guarantee does not cover; hypoglycemia, parasites,
giardia, viral or bacterial infections after the puppy leaves our care.
We do not guarantee against parvo, coccidiosis, distemper or corona virus
because these are highly contagious disease that can be contracted immediately
upon leaving our property. Seller makes no guarantee as to puppy’s fertility
or breeding abilities. The Buyer
agrees that if the puppy is to be shipped, Buyer has 12 hours after the time
of pickup to notify Seller of the puppy’s arrival. If Buyer does not notify
Seller within 12 hours after pickup of the puppy, all guarantees of this
contract are void. This puppy is guaranteed against congenital defects for 1
year after the date of sale of the puppy. If
puppy is found to suffer from a congenital defect by a certified veterinarian,
Buyer must notify Seller via certified mail, with written statement, and
complete medical records from the veterinarian within 24 hours.
Seller has the option to request a second vet
opinion before replacement is offered. Buyer understands that the following
genetic defects are not considered serious or life threatening and therefore
is not covered: umbilical hernia, undesended testicle, low grade heart
murmur, under-bite, over-bite, etc. Buyer understands that replacement
option is only valid when health problems are attributed to a hereditary
problem and not due to accident, contagious and/or other illness, or
environmental conditions. Buyer has the option to return the defective
puppy to the Seller, or to keep the puppy at Buyer’s expense. If a
replacement puppy is offered to the Buyer, from the first available litter
containing a puppy of equal value, it will be offered regardless of Buyer
keeping puppy or returning original puppy. Proof must be furnished to the
Seller that the defective puppy has been altered against ever being bred, if
it is to be kept by the Buyer, before a replacement puppy is offered. Under no
circumstances will the purchase price of the defective puppy be returned.
Seller has no obligation to reimburse Buyer for any costs incurred, i.e.,
medical, shipping, crate, etc. This is a replacement guarantee. No
monies will be refunded. Due to environmental effects on genetic conditions,
Seller has full discretion on offering a replacement puppy or not. Buyer
agrees to release and hold harmless Seller for any and all liability, damages,
or injuries, caused either directly or indirectly by Puppy to any person,
animal, whether actual or legal, or to any property whether real or personal.
Furthermore, Buyer assumes full liability for any damages or injuries, whether
physical or mental, emotional or economic, caused by Puppy, to any person
whether actual or legal, or to any property, whether real or personal, after
receiving and acknowledging delivery and possession of Puppy. Only
after the full amount of the agreed upon amount is paid, may the puppy be
removed from the Seller’s premises. This agreement is made and signed
by both parties to insure the well being and protection of this animal.
If any part of this agreement is breached, the Seller is released from any
further obligation hereunder. And Seller has full rights of repossession of
said puppy. Breeders’
First Rights To Refusal: This
states that I, the Seller, reserve the right to the said Dog if the Buyer for
ANY reason is unable to keep the said dog, Seller will either take back the
said Dog or help the Buyer
find an
appropriate
home for the
said dog.
This contract is NOT Transferable The Seller is to be notified should any
unusual health problems occur at any time or upon the death of this dog. If
this puppy should pass away, an autopsy is required. Breeder is to be notified
immediately, and provided with autopsy results and two separate vet statements
detailing the cause of the puppy’s death, in order for any refund to be
offered, if the cause of death is covered under the terms of our contract. The
Seller is to be notified should any unusual health problems occur at any time
or upon the death of this dog. If this puppy should pass away, an autopsy is
required. Breeder is to be notified immediately, and provided with autopsy
results and two separate vet statements detailing the cause of the puppy’s
death, in order for any refund to be offered, if the cause of death is covered
under the terms of our contract. This
Contract of Sale is an agreement a copy is retained by each Party. In the
event that any legal action or proceeding arises out or this agreement, Seller
shall be entitled to reasonable attorney’s fees and cost. Litigations shall
take place in a I
(or we) have read this Contract and understand and agree to all said Terms and
Conditions in this Contract. Date:

Contract is to be retained by both parties. Contract is effective once the
Seller has received a deposit and signed contract by Renay Arduser or Ken
Arduser. There shall be no
alterations made to this contract. If changes are made to the said contract,
charges will be filed. There is no verbal contract only written. If
changes are made there will be a new contract drafted and signed by Renay
Arduser or Ken Arduser, There are NO EXCEPTIONS.
